I could be wrong, but I'm not sure you can get FCC modular approval of a simple FSK RF transmitter, even if it's in an ISM band. There are too many factors, such as TX duty cycle, etc, that are outside the control of a simple module. I'm sure you can find a transmitter that would be 'approvable', but you would have to implement the constraints in the device controlling the transmitter and submit it for testing.
